Before paying a deposit for an apartment in Vietnam, identify who is entitled to lease that exact unit, what every upfront payment covers and what happens if you must leave early. A 12-month lease does not automatically become penalty-free after 30 days' notice. The law treats a contractual end date, agreed early termination and a lawful unilateral termination as different cases. A cheaper advertised rent may become the expensive option when the landlord and refund terms are unclear.
Before you send a deposit: five decisions
- Locate the exact property. Ask for the full address, visit the actual unit or arrange a trustworthy live viewing, and try the real journey to work.
- Identify who can sign and receive payment. Ask the landlord or agent for evidence of authority to lease this unit and compare the payee details with the written agreement.
- Get one all-in written quote. Split deposit, advance rent, management fee, electricity/water billing and any agency charge. Ask for the refund and early-exit terms before transferring money.
- Confirm the foreign-guest reporting actor. Name the person who directly manages the accommodation and will complete the temporary-stay declaration after arrival; request proof that it was submitted.
- Protect the handover and exit. Photograph dated room and appliance conditions, record utility meter readings, obtain payment receipts and agree on a key-return and deposit-accounting process.
Failure scenario: You like an apartment but the intermediary asks you to pay immediately to a third-party account, will not show authority to let it, or refuses to say who handles your accommodation declaration. Do not transfer the deposit yet. Request a written explanation and matching evidence; if it is not provided, compare another unit rather than relying on the listing photos. A receipt after payment is not a substitute for validating the recipient first.
Compare the type of accommodation
| Choice | Clarify these differences |
|---|---|
| Regular apartment | Furnishing, building charges, utilities and contract length |
| Serviced apartment | Which cleaning, linen, electricity and internet services are included |
| Shared room or house | Guest rules, deposits, shared costs and responsibility for damage |
| House | Maintenance, security, water, internet and access by motorbike or car |
| Short stay | Whether nightly price converts to a truly available monthly rate |
In Hanoi, a home near your intended office may save commute time even if the rent is higher. In Ho Chi Minh City, bridge and district routes can turn a short map distance into a long peak-hour trip. In Da Nang, beach proximity and rainy-season access can affect both convenience and price.
Get a proper written lease
The lease should identify the property, landlord, tenant, payment amount, currency, duration and permitted use. It should address utilities, deposit, early termination, renewal, repairs and refund arrangements. Request a version you can understand before signing and a written receipt for each significant payment.
An agent showing an apartment does not automatically prove that they or the person receiving payment is the owner or authorized representative. Verify the lessor and that their bank details match the agreement before sending money.
Ask what the rent excludes
An advertised apartment may be priced separately from electricity, water, internet, parking, building services and cleaning. Electricity can be a major variable if air-conditioning is used frequently. Ask for the billing method and actual service terms, not simply a guess from the landlord.
At the viewing, inspect the water supply and drainage, street noise, internet signal, elevators, fire-safety equipment and signs of moisture or leaks. Photograph the condition of furniture, walls and appliances before the handover.
The person receiving a deposit must be connected to the actual apartment
Ask for the exact street address, building and unit number, the owner's identity or evidence of the lessor's legal authority, and the written relationship between owner, representative and payment recipient. An agent may validly collect for an owner; a third-party account is not automatically fraud. Unexplained authority is the warning. If an agent insists on a same-day transfer to somebody unrelated to the contract, ask for the owner's authority and a receipt naming the exact apartment, purpose, amount and refund condition. If they cannot provide them, do not send the deposit.
Compare move-in cash rather than headline rent
Here is a hypothetical comparison, not a Vietnamese rental-market average. Apartment A charges VND12 million/month, two months' deposit and the first month's rent: VND36 million due before move-in. Apartment B costs VND13 million/month, one month's deposit and the first month's rent: VND26 million due. Apartment B needs VND10 million less immediate cash, despite costing VND1 million more each month. After ten months, the higher monthly rent would erase that upfront cash-flow difference, but a refundable deposit is not permanently spent. Compare cash locked up, actual recurring costs and your expected refund separately.
Get an itemized schedule for reservation money, a deposit securing contract performance (đặt cọc), prepaid rent and any agent/management fees. Civil Code Article 328 defines one kind of contractual deposit and contains default forfeiture/return consequences unless the parties agree otherwise. It does not mean every amount described colloquially as a “rental deposit” is automatically lost or automatically doubled on refund. Record its purpose and actual agreed consequences in writing.
A twelve-month contract does not always end on 30 days' notice
Housing Law Articles 170–173 in the 2025 consolidated official text distinguish: (a) expiry of the agreed lease term; (b) early termination by mutual agreement; and (c) the limited statutory grounds for unilateral termination, such as a landlord failing to repair severe damage, certain unreasonable rent increases, or third-party restrictions on the use of the property. Under Article 172(4), at least 30 days' notice normally applies when a party already has a lawful right to terminate unilaterally, unless the parties agree otherwise. It does not grant everyone a new cancellation right. The separate 90-day rule in Article 171(2)(a) concerns a defined lease with no agreed term and a landlord's notice—not every fixed-term renter.
Worked exit scenario: You signed for 12 months but must leave after month eight because your employer relocates you. A job transfer alone is not listed as a universal unilateral-termination ground under Article 172(3). If your contract contains no negotiated exit right, seek written mutual agreement, not a fictional “30-day law.” Before signing, propose a clause defining notice, early-exit charges or a replacement tenant, condition inspection, final bills, keys and a dated deposit accounting and repayment deadline. A representative should confirm whether the home is governed by the ordinary Housing Law or a real-estate-business lease regime before relying on a particular legal remedy.
Evidence for repairs and a deposit dispute
At move-in, inventory furniture, air conditioning, walls, locks, water and electricity meters, photograph existing defects with dates, and have both sides acknowledge the handover. If an unsafe leak develops, notify the owner in writing with photos, preserve their response and ask for a repair date. Do not unilaterally withhold rent or pay for large repairs expecting reimbursement without checking your actual agreement and legal basis.
At exit, record the final meter readings, key return, handover photos, any agreed deductions and the exact remaining deposit balance. If the landlord contests it, send a factual dated written request citing your contract, receipt, inventory and arithmetic. A civil deposit dispute is not automatically solved by a police report, and no court recovery is guaranteed.
Foreign renters and temporary-stay administration
Temporary-stay reporting is required for foreigners staying at accommodation in Vietnam, including rented housing or a private home; do not treat it as optional. Vietnam's Ministry of Public Security describes the responsible declarant as the person directly managing the accommodation. Before moving in, confirm with the landlord or accommodation manager who will submit the declaration and ask for confirmation that it was actually completed. Circular 87/2026/TT-BCA, effective 24 July 2026, requires the online declaration as soon as the foreigner arrives. If a legally permitted paper procedure is used, the ministry's October 2026 guidance describes immediate communication with local police followed by delivery of the paper form within 12 hours, or 24 hours in remote areas. Determine the applicable method with the local authority rather than assuming the paper option applies to your accommodation.
The Ministry of Public Security's unified accommodation-reporting service began on 21 May 2026; hosts should confirm access to its current portal and local procedure rather than rely on an obsolete accommodation-reporting website. Signing a lease does not grant permission to work or extend immigration status.
For complex long-term or ownership arrangements, use the current Ministry of Construction and Vietnamese legal-document sources plus professional advice. Avoid relying on old housing-law articles: the applicable legal framework changes and the details of a given contract matter.
The move-in and monthly budgets
Keep deposits and advance rent in a one-time cash table. Add monthly rent, utilities, food, transport, insurance and other personal spending to a separate recurring budget, and allow a reserve for replacement accommodation or travel changes.
The Vietnam budget calculator adds your VND estimates without asserting current rent prices. Compare two real addresses, confirm the exit conditions, and only then choose a lease.
